KHULIS: TERMS & CONDITIONS/AGREEMENT

PAYMENT IN ADVANCE
All work requires payment in full or a 50% deposit to start the process. All debit/credit cards (Visa, MasterCard, Discover, or American Express etc.) are accepted via Paypal (I am a Verified Member). Cash and money orders also welcome. Personal or business checks will not be accepted. A purchase made at this site is legal signature that you have read and agree to the terms and conditions. Model releases for adults and/or minors need to be signed where photography applies. Under no circumstances will Khulis be held responsible for delayed production of a project due to non-payment.

U.S. SHIPPING (only)
For printed material allow up to 10 business days and merchandise requires up to 3 weeks depending on your geographic location. Khulis will not be responsible for shipping delays or lost shipments. Be sure the shipping address is correct before submitting. Under no circumstances will a refund or reprint be honored for shipping delays or lost shipment.

COLORS ARE NOT GUARANTEED
Colors are not guaranteed, and I accept no responsibility for color variations between submitted files and the final printed piece. Under no circumstances will a refund or reprint be honored for color variations that may have occurred during the printing process.

DESIGN ERRORS
The displayed text should be proofread, all edits should be finalized, and all design issues should be corrected before submission to print. Khulis will not take responsibility for any copy or design errors committed on your part. Khulis is not responsible for any wrong dates or misspelled words in files submitted by customer or jobs approved by customer upon design completion. Under no circumstances will a refund or reprint be honored for an error in the submitted file or the design that was approved before submission to print.

CUTTING & SIZE LIMITATIONS
Accuracy of cutting is not guaranteed and by placing an order with Khulis you agree to this limitation. Khulis accepts no responsibility for cut variations since the blade can shift up to 1/8" in either direction (up, down, left, or right). It is strongly recommend that you do not use borders for prints. As a result of the blade being possible to shift by 1/8", folds and perforated lines may be off by 1/8". Under no circumstances will a refund or reprint be honored for cutting or size variations that have occurred during the printing process.

TURNAROUND TIMES ARE NOT GUARANTEED  If there are any turnaround times posted turnaround times are estimates and NOT guarantees. Several different things can go wrong during the printing process that can’t be controlled. Under no circumstances will a refund be honored for a delay in turnaround times.

CANCELLATION & REFUND POLICY
There is absolutely no way to cancel printed material or ordered merchandise. Under no circumstances will a refund be honored. No Exceptions! An exchange may be applied depending on the nature of the situation. Customer agrees that by placing an order, the customer has incurred and is paying for services provided and regardless of whether the customer refuses to take delivery of the ordered product. Khulis has rendered a product or service for which it shall be paid in part or in full. The customer agrees that by placing any such order, the customer will not cancel or terminate the order or refuse any such payment for the services provided. In addition, the customer authorizes Khulis to use these terms and conditions with any credit card company or financial institution to establish that customer is not allowed to cancel any such order and that any such charge-back is improper. In the event that the customer submits a 50% deposit to begin the design process, after 7 days of no contact with the customer that deposit is forfeited and will not be refunded. The customer agrees that they must place another 50% deposit again to continue business.

For photography sessions: a refund will be granted if cancellation is rendered prior to the date(s) scheduled, and preparation and/or advances have not been made toward the area or location. Money received by Khulis in whole or in part will be forfeited and there will be no refund under any circumstances. Rules from printed material enforced where it can be applied photography.

Services and Conditions of Use
Upon notice published through this website, we may modify these terms and conditions at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines listed.

Indemnification/Submissions
The customer will indemnify and hold harmless, Khulis and it's affiliates, from any and all loss, cost expense, and damages on any and all manner of claims, demands, actions and proceeding that may be instituted against Khulis on the grounds or basis alleging that said printing violates any copyright or any proprietary right of any person. You certify that you own the rights to use the image(s), information, or written submssion(s) being reproduced on your order or article.

Right to Subcontract
Khulis has the right to assign any portion of the work required to another contractor.

Image Use
Khulis is the owner and owns the rights to custom designed work. The customer has the right to print, publish, and advertise as desired but does not own the work. Khulis may use your product for samples or advertising purposes at any time. Purchases made at this site is legal signature that you agree to these terms.

Liability and Warranty
The user of this site agrees that they are taking advantage of this site at their own risk. Services provided are “As Is” without any warranty of any kind

This disclaimer applies to any damages or injury cause by any failure of performance error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, destruction, or unauthorized access to, alteration of, or use of record, whether breach of contract, tortuous behavior negligence, or under any other cause of action. Customer specifically acknowledges the service is not liable for defamatory, offensive or illegal conduct of other customers or third-parties and that the risk of injury from the foregoing rests entirely with the customer.  

Neither Khulis nor its affiliates shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to gain access to or use the service or out of any breach of any warranty. The customer hereby acknowledges that the provisions of this section shall apply to all content on the service.

Changes
Khulis may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless you’re notified otherwise. This policy was updated on November 28, 2008.
